Another Reminder Why Wyeth v. Levine is Necessary

How did pharmaceutial companies react to yesterday's Supreme Court decision, Wyeth v. Levine? With indignation: "We believe state courts should not be second guessing the doctors and scientists at the FDA." (NYT)

Darn those second guessers!

But wait a minute... what about when second guessing is necessary? (Newsday). The recent Newsday article reminds us why this is the case.

Just for kicks, here is a link that shows the actual warning that is on the phenergan label If you notice, it specifically states that it is not to be used inter-arterially.

This is a great case for showing that it is all about going for the deepest pockets and not about what is right. Now the better news, phenergan is coming off the formularies at our childrens hospitals. It was the only medication that worked for the nausea from chemo for many of our cancer kids. You have got to love our legal system.

The land pirates in my land pirate town are gearing up to go all out to plunder the pharmaceutical companies.

As a patient, I feel totally threatened by these lawyers. There is good moral and intellectual justification for bringing total street justice to these lawyers and the cult criminals on the bench.
