Almost Two Years Later, Policy-holders Await Katrina-Claim Justice

You may remember that Mississippi Attorney General Jim Hood dropped State Farm from his original lawsuit in January, when State Farm said it would make a settlement offer to Katrina-victim-claimants. This settlement offer was rejected by U.S. District Court Judge L.T. Senter, who said that the agreement kept the “claims handling procedure under the indirect control of State Farm.”

Well, five months later very little has changed, so the A.G. is suing State Farm. In a news release, he stated: “We filed this lawsuit in an effort to help the more than 30,000 Gulf Coast policyholders who have suffered for nearly two years because of State Farm’s inaction.”

Attorney General Hood's lawsuit is only one of many that State Farm has been dealing with. State Farm has recently been found to have breached the contract of its own agents. This is Case #C050591 from the Calif. Third Appellate District and is final as the Calif. Supreme Court refused to hear State Farm's appeal. This was final approximately April 2007 but State Farm has yet to even notify its agents of this legal decision. The question is if State Farm won't even honor its own contract with its own agents what chance does an average policyholder have?
