Putting the Tort “Reform” Cart Before the Safety Horse

If tort “reformers” and supporters of access to justice should be able to agree on one thing, it is that we should be taking steps to make hospitals safer, and getting rid of doctors who repeatedly make mistakes. While in reality tort “reformers” do not pay attention to the issue of safety, even though increased safety would mean less medical malpractice and less of the related lawsuits that they so decry, others are beginning to emphasize the need to focus increased attention on the modernization of our hospitals and patient care technologies. Here’s another empirical example of the need for this new focus on safety, before even beginning to talk about would-be “frivolous lawsuits.”
