Not Such a Rosy Picture for Tort “Reform” in Texas

During his State of the State address earlier this month Texas Governor Rick Perry tried to put a positive spin on the impact of the radical state constitutional amendment known as Proposition 12 that severely limited access to the courts for Texas families devastated by needless death or injury. Despite his rosy proclamations, the facts paint a different picture. Rural and underserved areas are still struggling to attract doctors, fewer counties have access to an obstetrician, and med mal insurance rates are still too high. Meanwhile, many folks who are harmed by a wrongdoer are no longer able to seek justice through our courts.

From the Austin Chronicle:

“Perry’s promises that frivolous lawsuits and high medical-malpractice insurance rates are down, and that the recruitment of specialists is on the rise, are just promises that haven’t panned out. In fact, it appears that the opposite may in fact be true.”

Too bad Governor Perry can’t be bothered with the facts. The truth is that so-called tort “reform” has been a failure for Texas families.
