Thoughts on the Idea of a “Tort Tax”

Tillinghast Towers-Perrin recently released its annual report chronicling what they term as a “tort tax” on Americans. I won’t take the time to go into detail about why this report is not helpful to a substantive discussion of our civil justice system, but will instead direct you to some previous posts on the report, as well as the full critique of the Center for Justice and Democracy.

Cyrus: Walmart carries about 10,000 lawsuits at any time. Have you met any upset or worried Walmart lawyer or supervisor of Walmart lawyer? I have never read nor heard of any upset. Why?

They are a corporation. They pass on all litigation and settlement costs to the customer, after tacking on a profit margin. This cost comes in the form of higher prices or reduced access. At the extreme end of the reduced access spectrum is bankruptcy of a provider of valuable services and products, far more valuable to our nation than the entirety of the lawyer profession.
